The article concerns a challenge by the American College of Emergency Physicians to a final rule regarding reimbursement of out-of-network, emergency care providers issued by the U.S. Department of Health and Human Services, the U.S. Department of Labor, and the U.S. Department of the Treasury. Ms. Medina states that because emergency providers are required by the Emergency Medical Treatment and Labor Act to see every patient who walks through the door, they are, at times, providing free care for those people that cannot pay. She further notes that “emergency care is really the safety net of the health care system, and it's becoming harder and harder every day to keep it alive.”
