Tom Krzeminski represents clients in high-stakes intellectual property and commercial disputes, with a practice focused on patent litigation, trade secret matters, and the regulatory issues that often shape business outcomes. A first-chair trial attorney with more than 25 years of experience, he is trusted by companies facing bet-the-company litigation where legal, commercial, and competitive interests are closely intertwined.

 

A particular strength of his practice is Hatch-Waxman litigation. In these cases, he has represented some of the world’s largest generic pharmaceutical manufacturers, as well as emerging branded companies preparing to bring their first products to market. Beyond the courtroom, Tom helps clients navigate the FDA’s complex regulatory framework, advising on issues affecting NDA, ANDA and 505(b)(2) approvals and the strategic considerations that can determine the success of a product launch. His experience also includes Section 337 investigations before the U.S. International Trade Commission and intellectual property disputes spanning industries such as pharmaceuticals, software, automotive, semiconductors, industrial chemicals, manufacturing, and consumer products.

 

Known for his oral advocacy and composure under pressure, Tom has earned the respect of clients, judges, and adversaries alike. Whether before a court, in a deposition, or across the negotiating table, he is valued for his ability to distill complex issues into persuasive, actionable arguments. Before joining Michelman Robinson, Tom served as a partner at leading intellectual property firms, where he litigated patent, trade secret, and complex commercial disputes nationwide. Earlier in his career, he clerked for the Honorable Ruggero J. Aldisert of the United States Court of Appeals for the Third Circuit. A frequent author and speaker on developments in intellectual property law, Tom has presented at ACI’s annual Paragraph IV Disputes Conference and was recognized by the Los Angeles Daily Journal as a featured contributor in the field of intellectual property.
