On January 2, 2018, Diyari Vázquez was quoted in the Restaurant Insider article, “Tip Pooling is Back and Here’s What it Means for Your Restaurant.”

On December 5, 2017, Marc Zimmerman was quoted in the Eater article, “Trump Is About to Make Tip-Pooling Legal Again. Here’s What That Means for Restaurant Workers.” In the piece, Mr. Zimmerman comments on the current tip-pooling regulations that were issued in 2011 under President Obama, and also provides some practical guidance regarding the period for public comment provided by the Department of Labor in connection with the proposed changes to the law.

Marc Zimmerman was quoted in the HR Dive article, “Compliance Challenge of the Year: State and local laws,” on December 4, 2017. In the piece, Mr. Zimmerman comments extensively on the likelihood that the Trump administration will ease restrictions placed upon the ability of employers to maintain tip pooling arrangements, and resulting state and local action where the hospitality industry is robust.

Diyari Vazquez was quoted in the Law360 article, “House OKs Narrowed Joint Employment Definition,” published on November 7, 2017. The piece addresses the vote by the U.S. House of Representatives to require “direct control” by a business partner in order to be subject to joint employer liability. Ms. Vazquez commented on the ongoing and commonplace practice of plaintiff’s suing based upon this legal theory.

Michael Poster, Chair of M&R’s Corporate & Securities Department, was instrumental in helping to close a big deal in the film music business: Concord Music’s recent acquisition of music label Varèse Sarabande from Film Score Records, an investor group led by The Cutting Edge Group (responsible for such well-known soundtracks as Whiplash, Sicario) and Barings LLC. Mr. Poster’s involvement was detailed in a recent Billboard feature, which also explained that Varèse Sarabande, under Concord Music’s ownership, will continue to release scores from major and independent film studios, network TV studios, digital streaming platforms, and A-list producers. The article also states that the purchase included the Varèse Vintage imprint that specializes in releasing new and re-issued albums by classic pop, jazz and country artists.

On June 25, 2018, Michael Poster was quoted in the Bloomberg Law article, “Calif. Employment Ruling Raises Copyright Ownership Questions.” In the piece, Mr. Poster raises the possibility that recent changes in how employees are classified in California may inadvertently impact copyright law and works made for hire.

On June 20, 2018, Jeremy Richardson was quoted in the Bloomberg Law article, “Play-Doh Scent Registration May Serve As Trademark Model.” In the piece, Mr. Richardson comments on Hasbro Inc.’s journey to trademark the iconic scent of Play-Doh, comparing the process to applying for a fragrance trademark.
