Appeals Court Gives Clarity to Voluntary Dismissals, but Inconsistency Among Judges Remains

Seth Darmstadter, M&R’s Class Action & Complex Litigation Practice Leader, was quoted in an article just published by the National Law Journal titled, “Appeals Court Gives Clarity to Voluntary Dismissals, but Inconsistency Among Judges Remains.” In the piece, Seth commented on a new opinion issued by the 11th Circuit clarifying that Rule 41 of the Federal Rules of Civil Procedure can be used to voluntarily dismiss entire lawsuits, but not individual claims.
