Shiftsmart is redefining workforce management by connecting skilled workers with flexible shift opportunities at scale. When its contract to provide personnel to market research giant Dynata LLC took a contentious turn, we stepped in to the fray.

Initially, Shiftsmart’s agreement with Dynata was mutually beneficial, but the relationship fractured when Dynata suddenly withheld $8 million in payments to Shiftsmart, alleging contractual breaches. The case went to trial in Dallas, Texas.

During the dramatic, week-long proceedings, evidence revealed that Dynata continued to rely on Shiftsmart’s services, even after asserting issues related to indemnification and insurance coverage. Further, testimony from Dynata’s own senior executives contradicted the company’s justifications for withholding payment. In fact, over and over again, our litigators dismantled Dynata’s claims, making the compelling case that its actions were unjustified and harmful to Shiftsmart’s business.

The jury agreed and ruled decisively in Shiftsmart’s favor, awarding the company approximately $14 million—$11 million in compensatory damages and $3 million in interest. This outcome reinforced Shiftsmart’s reputation as a trusted workforce solutions provider and set the stage for its ongoing success in connecting workers with meaningful opportunities.
