Warren Koshofer has spent his career at the intersection of law and business, advocating for clients in disputes where regulatory complexity and commercial risk collide. He counsels companies and individuals across the oil and gas, chemical, finance, real estate, luxury goods, and consumer products sectors.

Especially recognized for his work in environmental litigation, he handles matters involving Proposition 65, toxic torts, and environmental exposure. He also advises on mergers and acquisitions, delivering due diligence and risk assessments tied to environmental liabilities, insurance coverage, and indemnification. His work frequently touches on sustainability and ESG, particularly in the fashion and luxury goods industries.

He has represented clients in state, federal, and administrative courts across the country, litigating everything from contract and insurance disputes to intra-company conflicts and IP-related risks in commercial transactions. Many of his cases have helped shape how regulated businesses assess and respond to exposure.

With decades of litigation experience behind him, Warren brings a seasoned, measured perspective to each matter—helping clients stay focused, prepared, and in control through moments of legal and operational uncertainty. Representative Matters

  • Represented a client in a hard-fought case involving allegations of extortion, misuse of proprietary data, and reputational attacks . Obtained a $94 million judgment in the client’s favor.
  • Represented a client in a business and financial dispute, obtaining summary judgment that resulted in a judgment exceeding $12 million.
  • Defended a metal plating operation against CERCLA contribution claims tied to a $100 million+ cleanup sought by a neighboring property owner. After aggressive litigation and asserting counterclaims on the client’s behalf, secured a “walk-away” settlement dismissing all claims.
  • Represented a large international insurance company in litigation brought by a public company policyholder alleging that an insurance product was illusory, illegal, and part of a pattern and practice warranting over $100 million in damages. Devised a defense strategy that included suing the policyholder for unpaid premiums, ultimately securing dismissal of the plaintiff’s lawsuit and recovering approximately $5 million for the client.
  • Successfully defended the managing member of an LLC against claims by other members alleging misappropriation of corporate opportunities and breaches of fiduciary duty. Obtained complete vindication on all claims and an award of attorneys’ fees.
  • Successfully defended a client in an EPA enforcement action seeking millions in penalties for alleged regulatory violations related to hazardous air emissions. By pushing back on the proposed penalties rather than mounting a merit-based challenge, favorably resolved the dispute for only $5,000.
  • Defended a prominent insurance company in an arbitration in which the insured—covered under CGL policies issued by the client—sought the return of several million dollars paid toward deductible obligations. After mounting an aggressive defense, secured a mediation settlement requiring the insured to pay the client several million dollars.
  • Represented product manufacturers in coverage litigation against their liability insurers arising from environmental and toxic-tort claims. Overcame insurer defenses—including arguments that lower coverage layers were not exhausted and that occurrences fell outside certain policy years—ultimately driving the insurers to fund a major environmental cleanup and defend numerous related toxic-tort actions.
  • Defended a chemical manufacturer in more than 80 toxic-tort cases brought by teachers and students at an elementary school adjacent to a plating site where the client’s chemicals were allegedly used. Led the defense to achieve a highly favorable settlement for the client.
