Sukhi Kaler specializes in both domestic and international commercial litigation including cross-border disputes and enforcement. She covers the entire litigation process, from pre-action advice through to trial and appeals (including to the Supreme Court), advising on a wide range of complex disputes in a number of sectors including mining, aviation, banking and life sciences. Her practice regularly involves claims for breach of contract, fraud, jurisdictional challenges and environmental disputes.

A defining feature of Sukhi’s career is her long-standing role in Kuwait Airways Corporation v Iraqi Airways Company and the Republic of Iraq, one of the most significant and protracted cases in the history of the English Commercial Court. For over a decade, she played a leading role in trial, appellate, and cross-border asset-tracing and enforcement proceedings involving sovereign immunity, fraud, forgery and perjury, and multi-jurisdictional asset recovery exceeding US$1 billion. Her experience coordinating international counsel, managing large litigation teams, and advising boards and senior executives reflects her ability to lead at the highest level on bet-the-company disputes.

  • Represented Kuwait Airways Corporation in a complex series of Commercial Court proceedings and appeals arising from the 1990 invasion of Kuwait by Iraq. The matter involved claims against Iraqi Airways and the Republic of Iraq, advising on state immunity and act-of-state doctrines, worldwide freezing orders, sanctions, fraud, forgery, and perjury, and securing judgments exceeding $1 billion. Cross-border enforcement addressed UNSC Regulation 1483, Bank of England licensing requirements, joinder of Iraqi ministries and state-owned banks, issues of public international law, and piercing the corporate veil.
  • Represented one of the world’s largest global mining companies in a dispute arising from a Share Purchase Agreement and also in connection with a pricing dispute.
