California’s new AI employment law doesn’t create a CCPA safe harbor

A manager reviews an AI-generated recommendation to terminate an employee and approves it. Is that enough to satisfy California law? Not necessarily. Writing in the Daily Journal, Aaron Plesset explains why California employers need to pay attention to two different sets of rules governing AI-assisted employment decisions. Under the state’s new “No Robo Bosses” law, human corroboration of an automated recommendation may satisfy certain requirements. But the California Consumer Privacy Act (CCPA) sets a different standard for meaningful human involvement, and compliance with one law doesn’t guarantee compliance with the other. Aaron examines what employers should know about these overlapping requirements and why a manager’s approval alone may not be enough.
