John Giardino is the Managing Partner of M&R’s New York office. He is a trial lawyer sought after to handle the most challenging, high-stakes cases, including the $1.2B collapse of New York State’s Workers’ Compensation Self Insurance Program. John also acted as trial counsel for the developers of the landmark redevelopment of The Apthorp on New York’s Upper West Side after the project’s lender Anglo-Irish Bank was taken over by the Irish government. These are just a sampling of the newsworthy matters John has litigated. Given his body of work in the courtroom, John is one of the select few legal professionals chosen to serve on the American Board of Trial Advocates (ABOTA) COVID-19 Task Force, created to address pandemic-related issues impacting the legal profession, the judicial system, and the public.

A renowned transactional attorney as well, John has structured complex transactions such as the $1.4B bond program for modernization of an urban school district. Likewise, he has spearheaded several deals allowing health care institutions to improve building systems and medical technology and instrumentation.

Outside M&R, John is quite active in the community. He has been appointed by three different Governors of the State of New York to serve on the City of Buffalo Financial Control Board, the Niagara River Greenway Commission, and the H. H. Richardson Historical Site Commission. There is more. John’s community service includes positions on the Boards of the Urban League, the NAACP, the National Conference for Community and Justice, the Olmsted Conservancy, and many other civic organizations. By virtue of his philanthropic work, John has received several awards and recognition. One honor of particular significance was John’s selection to carry the Olympic Torch for the Summer Olympic Games in Atlanta.

Representative Matters

Commercial Litigation:  Represented hundreds of companies across New York in class action litigation with third-party administrators of group self-insurance trusts.

Commercial Litigation:  Represented developer in litigation with mortgage lender over advances, completion milestones, and funding restrictions imposed by regulatory takeover.

Commercial Litigation:  Represented owner of Dutch Masters painting in litigation with insurer over theft claims.

Business Transactions:  Represented developer in multiple Freddie Mac financings of multi-family housing projects.

Business Transactions:  Oversaw restructuring of health care supply company whose previous management team engaged in fraudulent billing practices.

Business Transactions:  Structured the bond financings for the transfer of loss portfolios held by employer group self-insurance trusts.
