Jackie Joseph is of counsel in M&R’s Los Angeles office and a member of the firm’s Commercial & Business Litigation Practice Group. She has been a civil litigator handling matters in state and federal courts for more than twenty-five years, and over that period, has compiled a remarkable record of wins at trial, arbitration, and mediation.
Having worked on a wide range of commercial and business disputes, Jackie has particular expertise in cases involving entertainment-related issues, intellectual property, construction, corporate governance, business torts, product liability, and real estate. She is also sought after for her representation of clients in adversary proceedings before the USPTO Trademark Trial and Appeal Board.
Prior to embarking on her career in the private sector, Jackie was an Assistant County Attorney for the Broward County Attorney's Office in Fort Lauderdale, Florida, a position that helped to hone her extraordinary skills in the courtroom.
Beyond M&R, Jackie is a volunteer for Reading Partners Los Angeles, a federally funded literacy program available to Title I schools.
Successfully defended producers of an Academy Award© winning film against claims for misappropriation of likeness, defamation, among others, including preparation of a motion to strike that resulted in dismissal of all claims and an award of attorneys’ fees. Successfully defended the subsequent appeal of the case to the Ninth Circuit (and ultimately to the U.S. Supreme Court, which denied certiorari).
Challenged multiple trademark registrations on behalf of movie and entertainment icon, which resulted in the wholesale cancellation of trademark registrations that infringed upon icon's name.
Successfully represented prominent production company in profit participation dispute brought by creator of reality-based television series, which included compelling arbitration and eventually resulted in a favorable settlement for the client.
Successfully defended developer and majority landowner in 200-acre development in Loomis, CA in a lawsuit over deposits allegedly owed to a Conservation Steward by the developer. Successfully moved to expunge a lis pendens on 51 lots and ultimately obtained a dismissal of the action and the imposition of a significant attorney fee award in favor of the client. Subsequently defended the same client in a multi-phase arbitration related to the transfer of declarant rights and construction and conservation easement issues.
Obtained favorable settlement for developer of $16M home situated on former Pickfair Estate in Beverly Hills, CA, in action for breach of promissory note and judicial foreclosure, and defended against construction defect claims.
Obtained defense verdict on behalf of a bestselling author against breach of contract claims brought by two production companies in connection with the production of two motion pictures based on the author's bestselling book series.
Successfully represented large hospital system, including obtaining summary adjudication of claims, in an action involving alleged damages in excess of $10M arising from alleged fraud, breach of contract, and intentional interference with contract.
Obtained summary judgment and a significant attorneys’ fee award for the liquidation division of national overnight shipping company in a federal lawsuit alleging breach of contract and related claims.
Obtained favorable settlement for foreign finance/real estate investment company against contractor of $16M project in a construction defect lawsuit with complex financial and insurance issues. Obtained a TRO and preliminary injunction against defendant and settled matter with multimillion-dollar payment to client.
Won summary judgment for an international pharmaceutical company in a nationwide product liability class action.
Obtained favorable settlement for an international technology company in connection with the misappropriation of trade secrets involving wireless data transmission technology.
Successfully appealed a summary judgment order on behalf of a bestselling author, which resulted in a favorable settlement involving rights to intellectual property.
