David Dehoney is a Partner in M&R’s New York office and the firm’s Energy Litigation Practice Leader. His work encompasses a wide range of disputes, including those arising in the energy, technology, finance and insurance spaces.

Over the years, David has participated in trials and hearings in breach of contract, tort, intellectual property, and securities cases, and he has represented clients before numerous federal district and appellate courts, arbitrations in a variety of forums, and state trial and appellate courts in New York, New Jersey, Delaware and West Virginia. He also handles sensitive investigations, having been involved in internal inquiries and audits for institutions in the U.S., Switzerland, Israel and other foreign jurisdictions.

In addition, David is a Certified Information Privacy Professional/United States (CIPP/US) through the International Association of Privacy Professionals (IAPP) and has significant counseling experience in cybersecurity & privacy matters. These include international data protection and cross-border transfers.

Past Experience

Prior to joining M&R, David honed his litigation and investigative skills at one of the most prestigious international law firms in New York. He worked as a law clerk at Kim & Chang, the largest law firm in Korea, as well.

Representing EQT Corporation and affiliates in defending against class action claims in the Northern District of West Virginia and on appeal before the Fourth Circuit Court of Appeals.
Representing EQT Corporation and affiliates in defending against royalty claims in state courts in West Virginia.
Representing Energy Transfer Equity in insurance coverage action against more than a dozen insurance carriers in Delaware state court and on appeal before the Delaware Supreme Court. Secured decisive victory on appeal holding that the insurance carriers are subject to personal jurisdiction in Delaware and allowing $2 billion coverage suit to proceed.
Representing one of the world’s leading technology companies in responding to data breaches and pursuing coverage under cybersecurity insurance policies.
Representing trustees in complex securities claims against financial institutions, mortgage originators and servicers in New York State Court Commercial Division (Part 60) and on appeal before the First Department of the New York Supreme Court Appellate Division. Obtained significant wins before trial and appellate courts resulting in highly favorable settlement.
Representing Xerox Corporation and New Jersey Transit Corporation in defending against patent infringement and trade secret claims in the Southern District of New York.
Represented VeriFone in federal and state court actions involving false advertising claims, patents on payment terminal security, and contract and tort claims, including obtaining the denial of a preliminary injunction of VeriFone’s advertising campaign.
Represented BMC Software, a leading provider of information technology service management (ITSM), in patent litigation in the Eastern District of Texas.
Represented Philips Electronics in worldwide litigation involving Philips’ patents on CD and DVD technology.
Represented Novo Nordisk in patent infringement actions relating to diabetes products in the District of New Jersey and on appeal before the Federal Circuit Court of Appeals.
Represented animation company in patent and trade secret claims against one of the world’s largest theater companies in AAA-ICDR arbitration in New York.
Represented Canadian mining company in international arbitration against the government of Kyrgyzstan before the Permanent Court of Arbitration.
