Tim Gorry is a partner in M&R’s Los Angeles office and its E-commerce, Banking and Media Litigation Chair. Represented high profile politician in construction defect arbitration after discovery of dozens of defects in the construction of his primary residence, after year long mediation, arbitration and a separate Superior Court action, settled case on terms favorable to client.
Represented REIT limited partnership which purchased a foreclosed development in multi-million dollar lawsuit against National Bank arising out of an indemnity provision agreed to by the Bank in the Purchase and Sale Agreement. After seven years of litigation, prevailed on a two week bench trial and secured a multi-million judgment and attorneys fee award for the client.
Represented National Insurance Company over trademark infringement by a competitor in a Federal Trademark action. After filing the complaint and engaging in initial discovery, settled on terms favorable to the client shortly after filing Motion for Preliminary Injunction.
Defended purchaser of a foreclosed development in multi-million dollar lawsuit by former developer in Placer County arising from an amended Deed of Trust filed by plaintiff days before foreclosure. After successful demurrers and motions for summary judgment prevailed on a bench trial and secured a significant attorneys fee award for the client.
Represented Los Angeles Unified School District as part of team defending client in multimillion dollar construction lawsuit, took and defended numerous depositions of defendants and experts and was part of trial team that prevailed after a 2 month jury trial.
Represented auto parts manufacturer in a Trade Dress action against infringing competitor filed in State Court. After extensive discovery practice and a pending Motion for Preliminary Injunction, settled with defendant who agreed to a redesign and to withdraw the offending products from the marketplace.
Represented prominent internet health products company in action against former employee and logistics company for diversion of product for employee’s personal benefit . After successful defense of demurrers and extensive discovery, obtained favorable settlements for client.
Defended Fashion Designer in Federal copyright and trademark action brought by former employee over work for hire designs. After successful motions to dismiss and extensive discovery, later settled in ADR Services mediation (terms of settlement confidential).
Defended E-commerce aggregator and its founder in lawsuits by competitor who attempted to shut down client and halt fundraising in multi-jurisdictional Federal Court litigation claiming that client “stole” IP relating to business development and on-boarding procedures. After successfully consolidating two actions filed in Texas and California Federal Courts and successful Motions to Dismiss, settled the matters on terms favorable to clients.
Defended liquidation division of national overnight shipping company in a Federal Court lawsuit that the client was brought into shortly before trial that had been pending for over one year. Secured extension of trial, discovery and motion cut-off dates and after an extremely short discovery period filed a successful motion for summary judgment and obtained a significant attorneys’ fee award for the client.
Represented National Football League team in its lawsuit against its stadium’s Architects in an action regarding ADA defects discovered in prior class action. After extensive motion practice, dozens of depositions and successfully opposing defendant’s Motion for Summary Judgment, settled case on terms favorable to client on eve of trial.
Successfully represented the County of Orange in a complex software development case against Tata Consultancy Services arising from a failed development project for a Property Tax Management System. Took over 50 depositions of software developers, architects, project managers, and experts, and worked with team to analyze and digest millions of pages of documents to prepare for month-long jury trial in federal court. Obtained $26M settlement for the County and its taxpayers days before trial.
Represented motion picture producers and financiers regarding alleged copyright infringement by street muralists in Argentina—an action originally filed in Illinois and successfully moved to U.S. District Court for the Central District of California pursuant to a motion to transfer.
Defended developer and majority landowner of a 200 acre development in Loomis, CA in a lawsuit over deposits allegedly owed to a Conservation Steward by the developer. Successfully moved to expunge a lis pendens on 51 five acre lots and filed successive demurrers, resulting in dismissal of the action and the imposition of a significant attorney fee award in favor of the client. Also defended same clients in a multi-phase arbitration over claims relating to transfer of declarant rights and construction and conservation easement issues in a multi-week JAMS arbitration in Sacramento, CA.
Represented producer and financiers of Academy Award ™-winning film in an action alleging misappropriation of name and likeness by subject of a magazine article. The case, which was originally filed in New Jersey federal court, was transferred to Los Angeles pursuant to a successful motion to transfer and then dismissed in its entirety after prevailing on an anti-SLAPP motion. Successfully defended the subsequent appeal of the case to the Ninth Circuit (and ultimately to the U.S. Supreme Court, which denied certiorari).
Represented developer of a mix-use high rise development in Los Angeles in a dispute concerning the development, construction and tenancy issues. After a 10-day jury trial, obtained a significant verdict for client, and later settled in ADR Services mediation encompassing all related cases (terms of settlement confidential).
Represented developer of $16M home situated on former Pickfair Estate in an action for breach of promissory note and judicial foreclosure, and defended against construction defect claim in multi-party action. Settled on terms favorable to client two days before picking a jury for 12-week trial.
Represented private equity firm and Senior Managing Director in connection with an investment in a food product company that became insolvent. Obtained summary judgment in actions venued in superior and bankruptcy court in favor of Director and PE firm.
Negotiated settlement after a six-week bench trial in Los Angeles and adverse verdict against motion picture producer in a breach of fiduciary duty and breach of contract case involving the proceeds of a hugely successful film.
Represented same foreign finance/real estate investment company against contractor of $16M project in a construction defect lawsuit with complex financial and insurance issues. Obtained a TRO and preliminary injunction against defendant and settled matter with multimillion-dollar payment to client.
Represented foreign finance/real estate investment company in connection with five separate multifamily and mixed-use projects in Los Angeles County. Defended five breach of contract and injunctive relief actions filed in four different courthouses in L.A. by the co-investor/general contractor. In so doing, successfully defeated applications for TRO and motions for preliminary injunctions filed in each case. Also prepared and filed cross-complaints alleging breach of contract, fraud, conversion, breach of fiduciary duty, and for appointment of a receiver, and after forcing expedited discovery moved for and obtained the appointment of a receiver on each of the five properties. Cases favorably settled shortly thereafter.
Represented Grammy Award ™ winning recording artist in wrongful death case brought by relatives of decedent in Santa Maria, California, stemming from emergency room treatment given to artist during an unrelated action in the Santa Maria Superior Court. Filed successful CCP 128.7 motion after successive demurrers that served to dismiss the action against the client.
Represented IT Consulting Division of Fortune 100 electronics company in a nine-week jury trial in Hayward, California. The case involved breach of contract, breach of fiduciary duty, and breach of duty of loyalty relating to the establishment of a competing company by senior executives of client, and resulted in a multimillion-dollar jury verdict against former employees.
Represented studio services company in two-week bench trial concerning an alleged breach of lease for 20,000 sq. ft. studio space in West Hollywood, California. Prevailed on defense of complaint and cross-complaint resulting in significant verdict for damages and attorneys fees against plaintiff and cross-defendant. Plaintiff appealed decision, verdict was affirmed, and matter was settled after conclusion of appeal.
Represented former NHL player in connection with NHLPA dispute regarding career-ending injury. Filed an action against local hospital and its doctors and nurses which culminated in a three-week jury trial that ended in directed verdict against client, reversed on appeal and retried, resulting in significant settlement by several parties. Case was retried before a Los Angeles County jury in a two-week trial that resulted in a split verdict on liability. Matter was ultimately settled on a confidential basis.
Represented current NBA player in connection with lawsuit brought against him by a ticket broker for misuse of a personal credit card. Secured summary judgment on the complaint and cross-complaint for conversion.
Represented co-founder of medical infusion therapy company in lawsuit that was filed while he was honeymooning in China after his ouster from the company and subsequent to an emergency bankruptcy sale to a competitor. After settling out co-founder and directors, obtained multimillion-dollar verdict after four-week jury trial against competitor for conspiracy to interfere with employment agreement.
Represented owners of estate in Encino, California in construction defect lawsuit against contractor stemming from water intrusion and resultant damage on $3M remodel project. Sued over 23 different sub-contractors, obtained comprehensive Case Management Order, managed five experts, and settled the matter on extremely favorable terms for the client.
Represented writer of Tony Award ™-nominated musical against co-writer and producer in case alleging breach of oral agreement, negligent misrepresentation, fraud, and declaratory relief. After a 10-day trial in Los Angeles Superior Court, jury rendered defense verdict against client, but court granted requested declaratory relief, resulting in settlement between the parties regarding credit participation and allocation of profits.
Represented fledgling video game software division of Texas-based RBOC in AAA arbitration brought pursuant to the terms of a Software Development Agreement. Brought counterclaims for failure to meet deliverable schedule, obtained defense decision on original claim, and won uncollectible judgment on counterclaim.
Represented telephone credit card company in action filed in the U.S. District Court for the Central District in action against telecommunications carrier alleging breach of transmission agreements. Obtained multimillion-dollar verdict after eight-day bench trial.
Represented major national travel agency in IT lawsuit brought by a vendor in federal court alleging breach of a software development agreement. Won multimillion-dollar verdict in two-week jury trial on cross-complaint for breach of contract and successfully defended original complaint.
Represented officers and directors in defense of a wrongful termination lawsuit brought by co-founder of a construction materials company. Obtained a directed verdict in favor of clients during multi-week jury trial in the Los Angeles Superior Court.
