"Trials and Tribulations" of UST Fraud in CaliforniaPDF Professional Environmental Management Association (PEMA)
Lara Shortz spoke at the Professional Environmental Management Association (PEMA) Luncheon on the topic of “Funding and Legal Issues Regarding Cleanups.”
The objective of this program was to educate environmental consultants on the investigative initiatives undertaken by the State Water Resources Control Board (SWRCB) and recommend compliance and mitigation strategies to avoid legal problems.
Topics covered included:
- An update on anti-fraud initiatives at the Underground Storage Tank (UST) Cleanup Fund and the criminal and civil investigations and litigation that have ensued;
- Advice to environmental consultants who do remedial work and UST claimants on strategies to implement with respect to compliance with UST Fund regulations and mitigation of harm that may follow as they operate in this environment;
- Advice to claimants and consultants on implementing compliance programs that ensure UST common fraudulent schemes constitute violations of company policy.
