Your industry is under attack! Criminal and civil prosecutions of environmental firms and landowner claimants involved in remediation work reimbursed by California's Underground Storage Tank Cleanup (UST) Fund are here to stay. Indeed, the State Water Resources Control Board's (SWRCB) Office of Enforcement Fraud Waste & Abuse section, the governmental unit leading the charge, has now been made permanent.
Lara Shortz (Michelman & Robinson, LLP) and Mark Mermelstein (Orrick, Herrington & Sutcliffe) held an intimate roundtable discussion and were joined by leading members of the consultant community that is being targeted by these investigations. They discussed compliance strategies regarding UST Fund regulations and measures to mitigate harm that may follow from operating in this increasingly challenging environment. Lara and Mark have been involved in most of the cases initiated in this area by this governmental unit.
